Supreme Court annuls part of the Single Registry of Leases: What does it mean for landlords?

The Supreme Court has partially upheld the appeal against Royal Decree 1312/2024, which regulated the so-called Single Registry of Short-Term Leases and the Digital One-Stop Shop for Leases .

The ruling annuls the precepts related to the state unified registration procedure and the obligation to register the property in the Property or Movable Goods Registry to obtain a registration number that would allow advertising short-term accommodations on online platforms. The Court considers that the State exceeded its authority by regulating this procedure in such detail, encroaching on regional powers in housing and tourism matters.

Does this mean that all obligations disappear?

No. The sentence does not eliminate the regulation of tourist or short-term rentals . What is annulled is the single state registry system as it was designed.

The Court itself maintains that the State does have the power to regulate the Digital Single Window the coordination between administrations, the transmission of data by online platforms and the use of information for statistical purposes.
