
The Supreme Court has partially upheld the appeal against Royal Decree 1312/2024, which regulated the so-called Single Registry of Short Term Leases and Digital One-Stop Shop for Leases .
The ruling annuls the provisions relating to the single state registration procedure and the obligation to register the property in the Land Registry or the Registry of Movable Property to obtain a registration number that would allow short-term rentals to be advertised on online platforms. The Court considers that the State overstepped its bounds by regulating this procedure in such detail, encroaching on regional powers in matters of housing and tourism.
Does this mean that all obligations disappear?
No. The sentence It does not eliminate the regulation of tourist or short-term rentals What it nullifies is the state's single registration system as it was designed.
The Court itself maintains that the State does have the power to regulate the Digital Single Window , coordination between administrations, the transmission of data by online platforms and the use of information for statistical purposes.
How does this affect homeowners?
For owners, the main consequence is that the obligation linked to the single state registration in the Property Registry in order to advertise short-term accommodations on online platforms is cancelled.
However, the regional and municipal obligations that may apply to each dwelling remain important: licenses, responsible declarations, registration in regional tourist registers, urban planning regulations, community of owners statutes and other current requirements.
